These Terms govern the Make a Wish mobile application (the "App"), provided by Make a Wish Studio, Ukraine. By creating an account or using the App, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the App.
1. Eligibility and accounts
The App carries a 12+ Google Play content rating. This does not replace age, parental-consent, or contractual-capacity law. If local law requires parent or guardian authorization, you may use the App only with it. You are responsible for securing your Google account and device and must use only accounts you are authorized to use.
2. Entertainment disclaimer
Make a Wish is an entertainment and social-expression application. Mystery Coin fortunes, rewards, animations, prompts, and similar content are fictional entertainment—not medical, psychological, legal, financial, religious, or other professional advice. They do not predict events and must not be relied on for important decisions. We do not guarantee that wishes will come true or user content will be accurate or suitable.
3. User content
You retain ownership of content you submit. You grant us a non-exclusive, worldwide, royalty-free license, for as long as needed to operate the App, to host, store, reproduce, format, display, transmit, moderate, restrict, and delete it solely to provide, secure, moderate, and improve the App and comply with law.
Public wishes can be shown with your nickname and processed by automated and human moderation. Private wishes are intended for you and excluded from the public moderation dashboard and AI moderation, though infrastructure providers process them to store and deliver the service. You are solely responsible for submitted content and must have rights to it.
4. Prohibited conduct
- Harassment, threats, bullying, exploitation, or impersonation.
- Hatred, discrimination, terrorism, violent extremism, or promotion of violence.
- Sexual exploitation, any sexual content involving minors, or unlawful obscene content.
- Publishing private/sensitive information without authorization.
- Scams, spam, malware, illegal solicitation, or facilitating serious wrongdoing.
- Infringement of intellectual-property, privacy, publicity, or other rights.
- Manipulating likes, reports, purchases, balances, integrity checks, or security controls.
- Unauthorized scraping, automation, disruption, overload, bypass, or reverse engineering except where law expressly permits.
- Misleading, hateful, abusive, sexually explicit, or impersonating nicknames.
- Any violation of applicable law or Google Play policies.
Automated filters are imperfect. No warning does not mean content is permitted.
5. Moderation and enforcement
Users can report public wishes and block authors. We may use automated systems and authorized moderators to review public wishes and nicknames. We may hide, restore, remove, or preserve content; warn users; restrict features; suspend/delete accounts; and cooperate with lawful authorities. We need not pre-screen every submission and cannot guarantee immediate detection or removal. Request review at makeawishgame@gmail.com.
6. Virtual coins, rewards, and purchases
Coins are limited, revocable in-App entitlements. They are not money, stored value, cryptocurrency, or property; have no cash value; are non-transferable; and cannot be redeemed outside the App unless mandatory law says otherwise.
Purchases use Google Play and its displayed price, tax, payment, cancellation, and refund terms. Delivery may require verification and internet access. Except where law or Google Play requires otherwise, consumed virtual items are final and non-refundable. Statutory consumer rights remain unaffected. Promotional rewards may change or end. We may correct balances affected by error, duplicate fulfillment, fraud, chargebacks, or unauthorized activity, subject to law.
7. Intellectual property
The App, excluding user content, including software, art, animation, audio, branding, layout, and original text, is owned by or licensed to Make a Wish Studio. You receive only a personal, non-exclusive, non-transferable, revocable right to use it under these Terms.
8. Third-party services
The App relies on Google, Firebase, Google Play, and Cloudflare. Their own terms apply. We are not responsible for third-party outages, account actions, payment decisions, network conditions, or changes outside our reasonable control.
9. Availability and changes
We may update, modify, suspend, or discontinue features for security, law, improvement, or technical/commercial needs. We do not guarantee uninterrupted, error-free, or permanent availability. Notice will be provided where required.
10. Disclaimers
To the maximum extent allowed by law, the App is provided "as is" and "as available". We disclaim implied warranties of merchantability, fitness, non-infringement, accuracy, uninterrupted operation, and freedom from harmful components where legally permitted. We do not endorse user content or accept responsibility for decisions based on wishes, fortunes, nicknames, reports, or other content. Mandatory warranties and consumer rights are not excluded.
11. Limitation of liability
To the maximum extent allowed by law, Make a Wish Studio and its contributors are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages or loss of data, profit, goodwill, opportunity, or business interruption arising from the App, user content, third-party services, or inability to use the App.
Where liability cannot be fully excluded, aggregate liability is limited to the greater of the amount you paid directly for App purchases in the preceding 12 months or the minimum required by law. These limits do not cover liability that cannot lawfully be limited, including intentional misconduct or fraud. Statutory consumer rights remain unaffected.
12. Indemnity
Where law permits, you agree to indemnify Make a Wish Studio against third-party claims and reasonable costs resulting from unlawful content, infringement of another person's rights, or a material breach of these Terms. This does not apply where caused by our unlawful conduct or where mandatory consumer protection says otherwise.
13. Suspension and deletion
You may delete your account through Profile → Settings → Delete account. We may restrict or terminate access for material/repeated violations, fraud, security threats, law, or risk to users or the service, with notice or an opportunity to correct where reasonable and legally required. Provisions that must logically survive termination remain effective.
14. Governing law and disputes
These Terms are governed by Ukrainian law without depriving you of mandatory consumer protections or courts made available by applicable law. Before filing a formal claim, contact us so we can try to resolve it informally.
15. Changes
We may update these Terms, revise the date, and provide additional notice where required. If you disagree, stop using the App and delete your account. Continued use after the effective date constitutes acceptance where law permits.
